The 2018 Farm Bill made hemp federally legal, but 2026 has delivered more legal turbulence than any year since. Three forces are reshaping the market simultaneously:

The Texas Story: Ban, Lawsuit, and a Judge's Restraining Order

Texas became ground zero in early 2026 when the Texas Department of State Health Services finalized rules banning smokable hemp -- including hemp cigarettes and pre-rolls -- effective March 31, 2026. Manufacturer licensing fees jumped from $258 to $10,000 per facility. The Texas Tribune reported the rule targeted products regulators said were visually indistinguishable from marijuana.

On April 8, 2026, a Travis County district judge issued a temporary restraining order blocking enforcement, per a second Texas Tribune report. The industry lawsuit argued DSHS exceeded its statutory authority. As of this writing, hemp cigarettes are available again in Texas under the court injunction. The November 2026 Federal Deadline: Total THC Changes Everything

Buried in federal appropriations law is the most sweeping hemp change since 2018. The Continuing Appropriations Act, 2026, signed November 2025, redefined hemp using total THC -- including THCA, delta-8, and other isomers -- at the 0.3% threshold, and capped finished consumer products at 0.4 mg total THC per container. Legal analysis by DLA Piper notes this takes effect November 12, 2026. Many current THCA and hemp flower products may become non-compliant. Why States Are Restricting Smokable Hemp

The core issue is enforcement, not ideology. Standard field-test kits used by law enforcement cannot chemically distinguish legal hemp flower from marijuana.
